The Office of Management and Budget (OMB) approved OFCCP’s changes to the complaint intake procedures to simulate the Equal Employment Opportunity Commission’s (EEOC) two-step complaint process on June 30, 2023. The OFCCP will update systems by October 31, 2023 to accept complaints in additional languages to accommodate a diverse range of individuals.
Complaints may be submitted using the existing form until the new process goes into effect. The OMB Notice of Action approving OFCCP's request allows continued usage of the existing form.
The new two-step process will remain in effect until June 30, 2026.
The two-step process includes:
- Beginning November 1, applicants and employees of federal contractors or subcontractors submit their complaints using the newly created form.
- OFCCP will assess the submission for timeliness, jurisdiction, and validate merit for investigation or to be referred to another agency.
- If OFCCP determines it has jurisdiction, the complainant will use the revised CC-4 form to complete the second step.
It should be noted that the OFCCP has not published the final versions of these forms, nor made any official announcement of the upcoming change.
