EEO-1 Component 1 Instruction Booklet is now available; filing period ends December 5, 2023.

The Equal Employment Opportunity Commission (EEOC) announced the 2022 EEO-1 filing period will open on October 31, 2023 and end on December 5, 2023. The Filer Support Message Center, also called the filer help desk, will open on October 31 to assist with questions regarding the 2022 data collection. The 2022 redesigned EEO-1 Component 1 Instruction Booklet is now available. The EEOC expects to post the updated 2022 EEO-1 Component 1 Data File Upload Specifications on September 13, 2023.   

The Office of Management and Budget (OMB) extended approval of the EEO-1 form for only one year even though the EEOC requested a three-year approval. For the 2022 filing, multi-establishment filers are no longer required to file a separate report based on the size of an individual non-headquarters establishment. Employers must provide demographic data for all facilities, regardless of size.   

All employers with 100 or more employees working in the U.S. as well as federal contractors with at least 50 U.S. employees, are required to submit an EEO-1 report annually with the EEOC. The EEO-1 Component 1 report includes demographic data of employees, including race/ethnicity, and sex by EEO job categories.

 

 

 

The 2022 EEO-1 filing schedule is a departure from previous years filing deadlines in May or June. Another change from previous years is the streamlined EEO-1 filing. Even though there are no financial penalties for failing to file an EEO-1 report, the EEOC can obtain a U.S. District Court order to compel a company to file. According to the EEOC, the data collected from the EEO-1 reports is used to support enforcement actions, initiate research on employment patterns, and encourage self-assessment by employers.
