Female Sales Representative Was Paid Less Than Her Male Coworker, Federal Agency Charged
Spec Formliners entered into a 2 ½ year consent decree settling a lawsuit with EEOC. Spec Formliners will pay $105,000 to a former employee to resolve allegations of equal pay violations. In addition to the monetary settlement, the company will retain external EEO consultants who will help the company create, review, and revise its policies and procedures to comply with Title VII and the Equal Pay Act. Spec Formliners will also conduct anti-discrimination training and distribute the revised policies to all of its employees.
EEOC alleged that Spec Formliners paid a female sales representative less base pay than a male sales representative and that the female had to sell more to earn the same commission as her male counterpart.
The lawsuit was filed on November17, 2016 after EEOC attempted to reach pre-litigation settlement through the conciliation process.
