OFCCP to Withdraw Authority Over TRICARE Employers

TRICARE providers continue to have a temporary moratorium on compliance reviews until May 7, 2021

On November 6, 2019 OFCCP issued a Notice of Proposed Rulemaking (NPRM) in the federal register announcing that it is proposing to permanently end its jurisdiction over TRICARE health care providers. OFCCP’s goal is to “increase access to care for uniformed service members and veterans and to provide certainty for health care providers who serve beneficiaries of TRICARE.” OFCCP proposes to revise its definition of “subcontractor” to exclude health care providers with agreements to furnish medical services and supplies to those participating in TRICARE. The agency will also establish a national interest exemption from EO 11246, Section 503 and VEVRAA for TRICARE providers.

OFCCP previously put a temporary moratorium on compliance evaluations for TRICARE providers, which is in place until May 7, 2021.

OFCCP is requesting comments on the proposed NPRM. Comments will be accepted here until December 6, 2019. (Regulatory Information Number 1250-AA08)
