OFCCP is instituting a 60-day window to approve or deny FAAP applications
In September 2018, OFCCP proposed several changes to the current Functional Affirmative Action Program (FAAP) directive as outlined in our previous blog. This week, the agency submitted the revised FAAP directive to OMB for final approval with “no material changes” from what was proposed last year and went through a public comment period.
In response to the comments, OFCCP is instituting a 60-day window to approve or deny FAAP applications upon receipt of a “complete package.” Contractors have reported that the application process has typically taken up to 18 months to complete.
Upon receipt of final approval from OMB, the changes will become effective; however, the public has one more opportunity to submit comments for consideration by OMB. Comments are due by May 16, 2019 and can be submitted at www.regulations.gov.
