OFCCP Releases Revised Scheduling Letters

The following outlines the additions and deletions to the final letters

The Office of Management and Budget (OMB) has approved OFCCP’s requests to revise the scheduling letters that initiate compliance evaluations, focused reviews, and compliance checks. Copies of the letters can be found here.

Many of the significant changes requested by OFCCP were not adopted. The following outlines the additions and deletions to the final letters.

Section 503 (Disability) & Veteran (VEVRAA) Focused Review Letters – as there was not a previously approved scheduling letter to initiate Veteran-focused reviews, the new letter mirrors the obligations of the disability-focused review scheduling letter.

NEW

  • Assessment of Personnel Process – requires contractors to provide a “description of the review” instead of the date it performed its most recent assessment and the date of the next scheduled assessment.
  • Assessment of Physical and Mental Qualifications - requires contractors to provide “the schedule for the review” instead of the date of the most recent and date of the next assessment.
  • Electronic Submission of Data- unique to focused reviews, contractors “must” submit any of the requested information in electronic format if it is maintained in that manner.

Removed

  • Compensation Data – detailed compensation data for all employees.
  • Employee Data – detailed data on applicants and employees, including self-identification information; whether individuals were hired, promoted or terminated; the job titles and job groups for all applicants, hires, promotions, and terminations; and the dates of hires and promotions.
  • EEO-1 Reports – no longer required.
  • Audit and Reporting Systems – omits documentation demonstrating compliance with the audit and reporting system components.

Removed

  • OMB rejected OFCCP’s request for contractors to submit its written AAPs under E.O. 11246, Section 503, and VEVRAA.

Scheduling Letter & Itemized Listing for a Compliance Evaluation

NEW

  • Assessment of Personnel Process – requires contractors to provide a “description of the review” instead of the date it performed its most recent assessment and the date of the next scheduled assessment.
  • Assessment of Physical and Mental Qualifications - requires contractors to provide “the schedule for the review” instead of the date of the most recent and date of the next assessment.

Removed

  • Subcontractor Identification – the request to submit a list of subcontractor names and locations for three of the most recently awarded subcontracts.
  • Internal Promotion Pools – the identification of race and gender data for the internal promotion pools.
