OFCCP continues to aggressively investigate alleged hiring discrimination

Louisiana alcoholic beverages distributor to pay $175,000 to settle OFCCP charges of racial bias in warehouse hiring

Southern Glazer’s Wine and Spirits of Louisiana, LLC, will pay $175,000 to resolve OFCCP claims that the company systemically discriminated against black applicants in its hiring practices at its Saint Rose, Louisiana warehouse facility. The allegations are the result of a compliance review in which the OFCCP concluded that, from January 2008 to January 2009, the federal contractor discriminated against 467 black applicants for warehouse worker positions. OFCCP also found that Southern Glazer failed to keep complete and accurate employment records and failed to evaluate its selection procedures as required by OFCCP regulations.

Although Southern Glazer denies the OFCCP’s allegations, the company has, pursuant to a consent decree, agreed to the monetary settlement and also pledged to extend 13 job offers to affected class members. Chief ALJ Stephen R. Henley of the DOL’s Office of Administrative Law Judges entered an order adopting the consent decree on January 3rd.

Department of Labor files lawsuit against JBS USA Lux S.A. and Swift Beef Co. alleging hiring discrimination

During a compliance review, OFCCP found that the Texas facilities had systemically discriminated against qualified American Indian/Alaskan Native, African-American, Hispanic, and Caucasian applicants, while favoring Asian applicants, for general production jobs at their beef processing plant in Cactus, TX, from at least September 2007 through at least June 2010. The complaint also alleges that the discrimination may continue to the present.

This is the second lawsuit filed by OFCCP against the company. The first lawsuit, filed in December 1, 2014, alleges that the company’s Hyrum, Utah facility systemically discriminated against qualified female, Caucasian, African-American and Native American applicants seeking entry-level jobs at its beef processing plant at that location.
