Repeal has limited effect on private-sector employers.
On March 31st, 2017, North Carolina Governor Roy Cooper signed a bill that repeals H.B. 2 which required transgender individuals to use the bathroom in public buildings that matches the gender indicated on their birth certificates.
The new bill, H.B. 142, allows transgender individuals to use bathrooms of the sex in which they identify but pre-empts all localities from enacting or amending employment law legislation of any kind through December 1, 2020. This pre-emption is not limited to barring local bathroom access statutes or law prohibiting discrimination based on sexual orientation, but extends to local minimum-wage laws and ban-the-box ordinances.
